Bill of Lading – Terms & Conditions
The following clauses govern the carriage of goods under the Bill of Lading issued by Ibex Sea Shipping Limited.
Defines key terms such as Carrier, Merchant, Goods, Container, Freight,
Port-to-Port Carriage, Combined Transport and Vessel.
The contract is between the Carrier and the Merchant. All Merchants are
jointly and severally liable for obligations including freight payment.
The Carrier’s tariff is incorporated and includes charges such as demurrage,
detention, storage, and legal costs.
The Carrier may subcontract any part of the carriage. The Merchant agrees
to indemnify the Carrier against claims.
Specifies the Carrier’s period of responsibility for Port-to-Port and
Combined Transport shipments.
Carriage to or from the United States is subject to COGSA and the
Pomerene Act.
Limits Carrier liability and explains valuation, declared value,
and compensation rules.
Carrier is not liable for delays, schedule changes, or indirect losses.
Carrier may use any route, vessel, transport method or storage location.
Claims must be made within prescribed time limits. Jurisdiction is
London or New York (for U.S. trade).
Merchant is responsible for packing, sealing, and suitability of containers.
Conditions governing refrigerated and temperature-controlled containers.
Carrier may inspect, store, sell or dispose of goods when required.
Merchant warrants accuracy of cargo description and legality of goods.
Dangerous goods require prior approval and full disclosure.
Freight is due upon receipt of goods and is non-refundable.
Carrier has lien over goods for unpaid freight and charges.
Rules governing deck cargo, open containers and livestock.
Carrier may suspend, reroute or abandon carriage under adverse conditions.
Merchant must take delivery promptly or goods may be stored or sold.
Allocation of liability in case of collision involving shared fault.
General Average contributions governed by York-Antwerp Rules.
Invalid clauses do not affect remaining provisions.
Carrier may comply with government or authority directives at any time.
Confirms Ibex Sea Shipping Limited as the Carrier under this Bill of Lading.
